Government laid down the text of the proposal to the Act Amending the Aliens ActAt its session today, the Government of the Republic of Slovenia laid down the text of the proposal to the Act Amending the Aliens Act and submitted it for consideration to the National Assembly of the Republic of Slovenia for urgent legislative procedure.
According to the Resolution on National Security Strategy of the Republic of Slovenia, the pressure of migrant flows to the Republic of Slovenia may endanger the security and health of the nation's citizens, particularly in the eventuality of a sudden and mass influx of migrants. In order to ensure public order and internal security, the proposal anticipates certain measures for maintaining internal security and public order in the Republic of Slovenia in the event of mass and uncontrolled arrival of migrants and to enable the normal functioning of central state institutions and the provision of vital services.
The act proposal enables prompt and efficient treatment of aliens who do not meet the conditions for entry to the Republic of Slovenia, or are illegally staying in the territory where the proposed measure is to be implemented. This enables the Government to propose to the National Assembly of the Republic of Slovenia, at the request of the Ministry of the Interior, to decide on the application of measure under Article 10b of the Act, which refers to the treatment of aliens who wish to enter illegally at border crossings and aliens who enter the Republic of Slovenia outside border crossings, in the case of changed conditions in the field of migrations for a period of six months, with the possibility of an extension for another six months.
The proposal anticipates that in its proposal to adopt the aforementioned decision the Ministry of the Interior drafts an assessment of possible consequences of changed conditions in the field of migrations, particularly regarding the impact on public order and internal security of the state.
In the case of changed conditions in the field of migrations, the act proposal also determines that the police may take an alien who does not meet the conditions to enter the country, or an alien who entered the country illegally, to the national border and transfer them to the country from where they illegally entered Slovenia on the basis of the decision issued by the National Assembly of the Republic of Slovenia. The act proposal also determines that the government office responsible for the care of migrants ensures the right to basic care for aliens who are permitted to stay in the Republic of Slovenia. The Government of the Republic of Slovenia thus orders the Secretariat-General of the Government of the Republic of Slovenia to draft the Ordinance on the establishment of the Office for Migrant Care, whose main task would be the accommodation of, and care for, various categories of migrants.
